Terms of service

The short version: monitor only what you are allowed to monitor, do not use our checks to attack anyone, keep within your plan, and review what you publish. We run the service with care but the Free plan comes without guarantees.

The agreement

These terms are an agreement between you and HootCodes LTD ("we", "us"), the company that operates UpButler at upbutler.com. By creating an account, using the API or MCP server, or letting an agent act for you with an UpButler API key, you accept them. If you use UpButler for a company, you confirm you may bind that company, and "you" means the company.

Our privacy policy explains how we handle personal data and forms part of these terms.

Accounts and workspaces

  • A workspace holds your monitors, status pages and settings. Its owner is responsible for who they invite and what members do.
  • Keep your sign-in email and API keys secure. Anything done with your API keys, by you or by an agent you gave them to, counts as done by you.
  • You must be at least 16 years old to use UpButler.

Agent-created workspaces

AI agents can create a workspace through our API without a human account. Such a workspace starts on the Free plan with limited features (for example, email notifications are disabled) and comes with a claim link. The person who claims it accepts these terms for it from that moment, including for what the agent already set up.

Unclaimed workspaces are deleted automatically 7 days after creation, together with everything in them. Whoever runs the agent is responsible for how it uses UpButler before the workspace is claimed.

Acceptable use

UpButler sends requests to other people's infrastructure on your behalf, so we take this part seriously. You must not:

  • monitor systems you do not own or are not authorized to monitor;
  • use checks, scripts or browser checks for load testing, denial of service, brute forcing, vulnerability scanning or scraping;
  • use check intervals, many monitors or many workspaces to multiply traffic against a target;
  • try to reach private networks or internal addresses through our checks, or work around our safeguards against that;
  • publish unlawful, deceptive or infringing content on status pages, or impersonate another company's status page;
  • add people as status page subscribers without their consent, or use subscriber lists for anything other than status updates;
  • probe, overload or disrupt UpButler itself, or resell it without our written agreement.

We may throttle, pause or remove monitors that break these rules or that a target's owner credibly reports as unwanted, and we may suspend accounts involved. Where we can, we will tell you first.

Plans, limits and fair use

Each plan has the limits shown on our pricing page: monitors, check interval, status pages, members, subscribers, emails, AI reports and history. When you reach a limit, the related action is refused until you upgrade or free up capacity; we do not charge overages without asking.

Webhook deliveries and API calls are not metered by plan but are subject to rate limits and fair use: usage far beyond what is normal for your plan, or that harms other customers, may be limited. When you downgrade, nothing is deleted: monitors beyond the new plan's limit are paused (newest first) and can be resumed after upgrading, check intervals are slowed to the plan's minimum, and features the plan doesn't include, such as custom CSS or hidden branding, are switched off. Status pages, subscribers and history are kept.

We may change the Free plan's limits. For paid plans, changes that reduce what you get take effect at your next renewal after at least 30 days' notice.

Payment

Paid plans are sold through Polar, which acts as our merchant of record. When you buy a subscription, Polar is the seller: it processes your payment, issues invoices and handles VAT and sales tax. Polar's own terms apply to the payment.

  • Subscriptions renew automatically each month or year until cancelled.
  • You can cancel at any time from the billing settings; your plan stays active until the end of the period you paid for.
  • Prices may change; we will tell you at least 30 days before a change affects your renewal.
  • If a payment fails and is not resolved, the workspace returns to the Free plan.

If you are a consumer in the EU, you keep any statutory right of withdrawal that applies to your purchase.

Your content

You own what you put into UpButler: monitor configuration, status pages, incidents, notes and subscriber lists. You give us permission to host, process, transmit and display it only as needed to run the service for you, including publishing the status pages you make public.

For personal data of your status page subscribers and anything else you collect through UpButler, you are the controller and we are your processor, as described in our privacy policy. You are responsible for having a lawful basis to collect it.

You can export your data through the API at any time. After you delete it, we may keep backups for a limited time as described in the privacy policy.

AI features

AI incident reports, summaries and writing suggestions are generated automatically and can be incomplete or wrong. They are drafts. Review them before you rely on or publish them; you are responsible for what appears on your status pages and in your notifications, whether you, a teammate or an agent posted it.

Availability and support

We work hard to keep UpButler running and to deliver checks and alerts on time, and we publish our own status at upbutler.com/s/upbutler. Monitoring depends on networks and systems outside our control, so we cannot promise that every check runs or every alert arrives.

  • Free: provided as is, with no service level commitment and community-level support.
  • Paid plans (Starter, Pro and Business): email support at [email protected]. There is no uptime SLA or service credit unless we agree one with you in writing.

We may carry out maintenance, which we try to schedule outside busy hours and announce on our status page.

Suspension and termination

You can stop using UpButler and delete your workspace at any time. We may suspend or end your access if you seriously or repeatedly break these terms, if required by law, or to protect the service or third parties. Unless the situation is urgent, we will give notice and a chance to fix the problem. If we end the service for reasons that are not your fault, we will refund the unused part of any prepaid period.

Disclaimers

To the extent the law allows, UpButler is provided "as is" and "as available", without warranties of fitness for a particular purpose or uninterrupted operation. Nothing in these terms limits rights you have as a consumer that cannot be limited by contract.

Liability

To the extent the law allows, our total liability for all claims relating to UpButler in any twelve-month period is limited to the amount you paid us for the service in those twelve months, or 100 euros if that is greater. We are not liable for indirect or consequential losses, such as lost profits, lost revenue or the cost of an outage we failed to detect.

These limits do not apply to liability that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or for gross negligence or intent.

Governing law

These terms are governed by the laws of the country where HootCodes LTD is registered, and the courts of that country have jurisdiction, without depriving consumers of the protection of the mandatory laws and courts of the EU country where they live. We would rather resolve problems by talking: email us first and we will try to fix it.

Changes to these terms

We may update these terms as the product and the law change. For material changes we will email account owners and post a notice in the dashboard at least 30 days before they take effect. If you keep using UpButler after that, the new terms apply; if you do not agree, you can cancel before then.
